1. Eligibility and minors
You must be at least 13 years old and meet any higher minimum age required by Discord or the laws of your country.
If you are under the age of legal majority in your country, you confirm that your parent or legal guardian has reviewed and authorised your use of NexNode and your acceptance of these Terms. NexNode may request reasonable evidence of age or authorisation where legally necessary or where an account is suspected of being operated by an underage user.
You must have the legal capacity or necessary authorisation to enter into this agreement.
Users who do not meet these requirements may have their account and servers suspended or deleted.
2. Accounts and Discord integration
Some parts of the Service require a NexNode account, a valid Discord account, or both.
You agree to:
- Provide accurate and current information.
- Keep your login credentials and Discord account secure.
- Do not share, sell, transfer, rent, or misuse your account.
- Promptly report unauthorised access or security incidents.
- Remain responsible for actions performed through your account, except where caused by a failure attributable to NexNode.
Creating multiple accounts to bypass limits, queues, sanctions, verification, resource restrictions, or plan requirements is prohibited.
NexNode may limit the number of accounts, servers, linked Discord accounts, or active sessions associated with the same person, household, network, device, payment method, or Discord community when reasonably necessary to prevent abuse.
An account does not grant ownership of any NexNode infrastructure, allocated resources, server identifier, address, port, subdomain, slot, or feature.
3. Public beta and nature of the Service
NexNode, particularly its free plan, may be offered as a public beta, experimental service, or continuously developing platform.
Beta features may be incomplete, unstable, changed, suspended, reset, or discontinued. Errors, downtime, data loss, incompatibilities, performance variations, and unexpected interruptions may occur.
Unless expressly stated in a separate written service-level agreement, NexNode does not guarantee:
- Continuous or uninterrupted availability.
- Any minimum uptime.
- Immediate server creation or start times.
- Permanent access to a specific node or location.
- Dedicated or constant resources.
- Compatibility with every game version, mod, plugin, or configuration.
- Permanent storage or unlimited data retention.
- That beta features will become permanent.
The Service is not intended for critical, emergency, safety-related, archival, financial, or other workloads where interruption or data loss could cause significant harm.
4. Server creation and management
Servers may be created through the website, dashboard, staff-assisted procedures, or other supported interfaces.
The person creating a server is normally considered its primary owner within NexNode. Giving other users access does not transfer the primary owner's responsibilities.
Server owners are responsible for:
- Administrators and users they authorise.
- Server settings, permissions, whitelists, files, plugins, mods, worlds, databases, and configurations.
- Activity performed through their server.
- Compliance with game licences, software licences, third-party terms, and applicable law.
- Maintaining appropriate independent copies of important data.
NexNode may impose technical or operational limits on server creation, ownership transfers, administrator access, ports, databases, scheduled tasks, file uploads, network traffic, and other server functions.
5. Resources, capacity, and free-plan limits
RAM, CPU, storage, network traffic, player slots, databases, backups, server count, locations, ports, start priority, queue position, session duration, inactivity periods, and other resources may be limited.
Resources displayed in the panel represent maximum permitted allocations and do not necessarily constitute dedicated, permanently reserved, or continuously available resources.
In particular, NexNode may, for valid technical or operational reasons:
- Increase or reduce resource limits.
- Move servers between nodes or locations.
- Introduce, modify, pause, reset, or close start queues.
- Limit server performance or background activity.
- Stop servers after a session or inactivity period.
- Temporarily prevent new server creation.
- Prioritise certain plans, regions, games, or workloads.
- Impose emergency capacity restrictions.
- Discontinue an unsustainable configuration or free-plan feature.
Valid reasons include capacity management, infrastructure changes, maintenance, security, platform stability, supplier changes, excessive usage, abuse prevention, cost changes, legal requirements, technical compatibility, or development of the Service.
Where reasonably possible, NexNode will communicate significant changes in advance. Immediate changes may be made when necessary to address security incidents, active abuse, infrastructure failures, legal obligations, or urgent stability risks.
6. Fair use and prohibited activities
NexNode वैध समर्थित गेम सर्वर, Discord बॉट, वेबसाइट, कम्युनिटी, डेवलपमेंट प्रोजेक्ट और संबंधित होस्टेड ऐप के लिए है।
You must not use the Service to:
- Perform or facilitate cyberattacks, DDoS attacks, scanning, exploitation, credential theft, malware distribution, or unauthorised access.
- Mine cryptocurrency or perform proof-of-work, distributed computing, or similar resource-intensive workloads.
- अनधिकृत proxy, VPN, traffic relay, seedbox, सामान्य file-hosting सेवा या चुनी गई होस्टिंग से असंबंधित ऐप चलाना।
- Host illegal, fraudulent, infringing, abusive, hateful, sexually exploitative, or otherwise unlawful content.
- Store or distribute child sexual abuse material or content that exploits minors.
- Violate copyright, trademark, privacy, publicity, or other third-party rights.
- Bypass resource limits, queue systems, sanctions, technical restrictions, or authentication measures.
- Create multiple accounts or servers to obtain resources beyond permitted limits.
- Sell, resell, sub-license, or commercially redistribute NexNode resources without written authorisation.
- Interfere with other users, nodes, networks, systems, or NexNode personnel.
- Use excessive traffic, storage, CPU, processes, scheduled tasks, or other resources in a way that threatens platform stability.
- Impersonate NexNode, its staff, another user, or a third party.
- Use the Service in violation of Discord's rules or the licences and terms applicable to supported games.
Attempting, assisting, instructing, or enabling another person to perform a prohibited activity is also a violation.
7. User files and content
You retain any rights you have in the files and content you upload or generate.
You grant NexNode a limited, non-exclusive licence to host, store, copy, process, transmit, back up, migrate, and technically modify that content only as reasonably necessary to provide, secure, maintain, and improve the Service or comply with legal obligations.
You represent that you have the necessary rights and permissions for all uploaded files, mods, plugins, worlds, software, and other content.
NexNode does not acquire ownership of your server content merely because it is stored on NexNode infrastructure.
8. Security checks and content moderation
NexNode may use technical logs, automated security systems, malware detection, resource monitoring, abuse indicators, and, where reasonably necessary, human review to protect the Service and investigate suspected violations.
Access to user files by authorised personnel should be limited to situations reasonably necessary for:
- Technical support requested by the User.
- Infrastructure maintenance or migration.
- Security or abuse investigations.
- Responding to credible reports.
- Enforcing these Terms.
- Complying with legal obligations or valid authority requests.
NexNode is not required to proactively inspect every file or activity except where required by applicable law.
Illegal content or serious abuse may be reported to info@movara.it. Reports should identify the affected server or content and explain why it is allegedly illegal or violates these Terms.
9. Server stopping, suspension, restriction, and deletion
NexNode may stop, restrict, quarantine, suspend, reconfigure, relocate, or delete a server when reasonably necessary because of:
- A violation or suspected violation of these Terms.
- Illegal activity or a credible legal complaint.
- Security threats, malware, compromised credentials, or active attacks.
- Harmful or excessive resource usage.
- Attempts to bypass limits or sanctions.
- Inactivity or expiration of the applicable retention period.
- Non-payment, fraud, chargebacks, or payment disputes where paid services apply.
- Infrastructure failures, capacity shortages, or supplier changes.
- Discontinuation of a game, version, node, plan, or feature.
- Maintenance, migration, compatibility, or stability requirements.
- Requests from courts, authorities, rights holders, or other legally entitled parties.
- Protection of NexNode, its users, infrastructure, staff, or third parties.
Action may be taken without advance notice where immediate intervention is reasonably necessary for security, abuse prevention, legal compliance, infrastructure protection, or prevention of further harm.
In other cases, NexNode will use reasonable efforts to provide notice or an opportunity to download files when technically and operationally feasible.
10. Account restriction and termination
NexNode may restrict or suspend specific account functions, including login access, server creation, Discord account-linking features, file access, ownership transfers, support access, or participation in NexNode programs.
NexNode may terminate an account for serious or repeated violations, fraud, abuse, security risks, circumvention of previous sanctions, legal obligations, prolonged inactivity, or discontinuation of the Service.
Termination of an account may result in the immediate or scheduled deletion of all associated servers, files, databases, backups, configurations, and other data.
Where required by applicable law, NexNode will provide a clear reason for an account or server restriction unless doing so would:
- Violate the law or an authority request.
- Interfere with an investigation.
- Disclose confidential security information.
- Enable further abuse or circumvention.
- Create a risk to NexNode, another user, or a third party.
Users may request a review of an enforcement decision by emailing info@movara.it. Submission of an appeal does not automatically suspend or reverse the decision.
NexNode reserves the right to refuse future registrations from users whose accounts have been terminated for serious abuse.
11. Backups, retention, and data loss
Users must maintain independent copies of important server files and data.
Backups, where offered, are a convenience feature and are not guaranteed unless expressly stated in a separate written agreement. Backups may be incomplete, unavailable, overwritten, corrupted, or subject to retention and storage limits.
NexNode may establish inactivity and retention periods for free servers and accounts. Those periods may be displayed in the dashboard, documentation, server creation flow, or plan description.
When a server or account is deleted, associated data may become permanently unrecoverable. NexNode is not required to retain deleted data beyond any period required by applicable law.
Nothing in this section limits any mandatory right a consumer may have to retrieve eligible content under applicable digital-service law.
12. Supported games and third-party software
NexNode may add, validate, update, restrict, or remove supported games, versions, modloaders, templates, or server software based on stability, compatibility, security, licensing, cost, capacity, or community demand.
A request for a game or feature does not create an obligation to implement it.
Games, Discord, control panels, mods, plugins, launchers, and other third-party services are governed by their respective owners' terms. NexNode is not affiliated with or endorsed by those third parties unless expressly stated.
NexNode is not responsible for changes, outages, restrictions, licensing decisions, or security issues caused by third-party services or software.
13. Paid services, orders, renewals, and consumer rights
NexNode may offer paid Server & Bot plans, Web Hosting plans, credit packages, Custom plans, and other paid features. Before an order is placed, the checkout shows the selected service, billing period, total price including applicable taxes, included resources, renewal method, minimum term, and any specific restrictions. The checkout summary prevails for the commercial details of that order.
A paid service is not treated as a beta merely because separate free features are in public beta. If a paid feature is experimental, that status and its material limitations will be disclosed before purchase and do not remove mandatory consumer rights.
A recurring service renews only where the User has expressly selected or accepted recurring billing. The User may stop future renewals through the available account controls or support channel. Cancellation of renewal does not normally end the already paid period. One-off credit purchases do not renew automatically unless the checkout clearly states otherwise and the User expressly agrees.
Consumers entering a distance service contract generally have 14 days to withdraw, subject to mandatory exceptions and the rules applicable to services or digital content. If the consumer asks NexNode to begin performance during that period, NexNode may request the express consent and acknowledgements required by law. On withdrawal after performance has begun, a proportionate amount may be due where permitted by law. No wording in these Terms removes mandatory rights concerning withdrawal, conformity, repair, price reduction, termination, or refund.
If a paid digital service is not supplied or is not in conformity, NexNode will provide the remedies required by applicable law. Refunds, credits, or extensions offered voluntarily do not replace statutory remedies.
- Payments may be processed by an authorised payment provider. NexNode does not need to receive or store the full payment-card number.
- Failed, reversed, fraudulent, or disputed payments may prevent activation, renewal, or continued use of paid resources while the matter is investigated.
- Upgrades, downgrades, prorating, and immediate resource changes apply only as shown and confirmed before the relevant order.
- Invoices, receipts, and tax information are issued according to the information supplied by the User and applicable law.
- Promotional prices, trials, and bonus resources may have separate eligibility, duration, and renewal conditions shown before activation.
14. Changes to the Service
NexNode may modify the Service for valid reasons, including security, legal compliance, technical development, infrastructure changes, compatibility, capacity, cost control, abuse prevention, user demand, or improvement of the Service.
Changes will not create an additional charge without the User's agreement.
Where a change materially and negatively affects a consumer's continued access to a digital service, NexNode will provide notice and any termination or refund rights required by applicable law.
No provision of these Terms removes mandatory legal protections applicable to consumers.
15. Changes to these Terms
NexNode may update these Terms to reflect:
- Changes to the Service or available plans.
- New features or infrastructure.
- Security or abuse-prevention requirements.
- Changes in law or regulatory guidance.
- Clarification of existing provisions.
- Changes to third-party services.
- Legitimate operational requirements.
The current version will always be published at /terms.
NexNode will communicate material changes through the website, dashboard, Discord bot, email, Discord announcement, or another reasonable method. Unless an immediate change is required by law or security needs, material changes will take effect on the date indicated in the notice.
Continued use after the effective date constitutes acceptance where permitted by law. If you do not accept an updated version, you must stop using the Service and may terminate your account.
16. User termination
You may stop using NexNode at any time.
Where available, you may delete servers or request deletion of your account through the dashboard or support. Account deletion may permanently remove all associated servers and data.
NexNode may retain limited information after termination where necessary for legal compliance, fraud prevention, security, dispute resolution, accounting, or enforcement of these Terms, as described in the applicable Privacy Policy.
17. Privacy and personal data
Personal data relating to the Service is processed in accordance with the NexNode Privacy Policy available at /privacy.
The applicable privacy information identifies the data controller, purposes and legal bases of processing, recipients, retention periods, international transfers, user rights, and contact details.
These Terms do not replace the applicable privacy information.
18. NexNode intellectual property
NexNode and its licensors retain all rights in the NexNode name, branding, website, bot, dashboard, software, interfaces, documentation, graphics, and original platform content.
You receive a limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose while your account remains active.
You may not copy, reverse engineer, exploit, resell, reproduce, or create derivative products from protected NexNode materials except where expressly permitted by law or written authorisation.
19. Disclaimer of warranties
To the maximum extent permitted by law, free and beta services are provided on an 'as available' and 'as is' basis.
NexNode does not warrant that the Service will be uninterrupted, error-free, completely secure, compatible with every configuration, or free from data loss.
Nothing in these Terms excludes statutory warranties, conformity obligations, or other rights that cannot legally be excluded for consumers.
20. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, wilful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or mandatory consumer rights.
To the extent permitted by law, NexNode is not liable for indirect or consequential losses, lost profits, lost opportunities, lost reputation, or losses caused by:
- User configurations or uploaded software.
- Unsupported mods, plugins, or game versions.
- Third-party platforms or suppliers.
- Attacks or unauthorised access not caused by NexNode's failure to exercise legally required care.
- Failure to maintain independent backups.
- Legitimate enforcement actions taken under these Terms.
For Users acting for business or professional purposes, NexNode's aggregate liability is limited to the amount paid to NexNode by that User during the 12 months preceding the event giving rise to the claim.
This business liability cap does not apply to consumers where it would restrict mandatory rights.
21. User responsibility and indemnification
Users remain responsible under applicable law for their conduct, uploaded content, server administrators, and violations committed through their accounts.
Users acting for business or professional purposes agree, to the extent permitted by law, to indemnify NexNode against third-party claims, penalties, and reasonable costs resulting from their unlawful content, intentional misconduct, or material violation of these Terms.
This provision does not impose liability on a consumer beyond what is permitted by applicable law.
22. Events outside NexNode's reasonable control
NexNode is not responsible for delays or failures caused by events outside its reasonable control, including natural disasters, power or network failures, upstream provider outages, DDoS attacks, war, civil disorder, government action, labour disputes, widespread software vulnerabilities, or failure of third-party infrastructure.
NexNode will take reasonable steps to reduce the effects of such events where practicable.
23. Governing law and disputes
These Terms are governed by Italian law, without prejudice to mandatory protections granted to consumers by the law of their country of residence.
For consumers, jurisdiction lies with the courts determined by applicable consumer law, including the competent court of the consumer's place of residence where required.
For Users acting exclusively for business or professional purposes, the courts competent for the Service operator's registered office shall have exclusive jurisdiction, unless otherwise required by law.
Before starting formal proceedings, Users are encouraged to contact NexNode at mosrls@pec.cgn.it to attempt an amicable resolution.
24. General provisions
If any provision is found invalid or unenforceable, the remaining provisions remain effective. The invalid provision will be interpreted or replaced only to the minimum extent necessary to make it lawful and enforceable.
Failure by NexNode to enforce a provision does not constitute a permanent waiver of that provision.
NexNode may assign these Terms as part of a merger, corporate reorganisation, sale of the Service, or transfer to an affiliated operator, subject to applicable law and any required notice.
These Terms, the applicable Privacy Policy, applicable plan descriptions, and any specific checkout terms form the agreement between NexNode and the User concerning the Service.

26. Partner Program
The NexNode Partner Program is an optional and discretionary initiative intended to support selected community projects.
Admission to the Partner Program does not constitute a vested right and does not guarantee the permanent retention of any assigned resources, configurations, or benefits.
Resources assigned through the Partner Program may differ from standard plans and are determined exclusively by NexNode according to the project's needs, infrastructure availability, and the objectives of the program.
NexNode may, at any time and in its reasonable discretion:
- Modify the assigned resources.
- Increase or reduce RAM, CPU, storage, or other limits.
- Modify server configurations.
- Transfer servers to different nodes.
- Modify or update the conditions of the Partner Program.
- Temporarily suspend new admissions to the program.
- Revoke participation in the Partner Program.
Participation in the Partner Program implies acceptance of any changes communicated by NexNode.
Free-plan slots and resources remain separate from those assigned through the Partner Program. Unless authorised in writing by NexNode, they may not be used to create additional servers, proxies, lobbies, game modes, bots, or other services directly or indirectly connected to the Partner project.
Using free slots to extend, divide, or circumvent the assigned Partner configuration constitutes improper use of resources and may result in resource reductions, deletion of the affected servers, or revocation of the Partner Program.
Free slots may be used for separate personal projects, provided they are genuinely separate from the Partner project and comply with the limits of the free plan.
27. Review and revocation of the Partner Program
NexNode may periodically review any project participating in the Partner Program.
The partnership may be modified, suspended, or revoked, including but not limited to, in the following cases:
- The project is inactive or substantially abandoned.
- Development is no longer considered sufficient.
- Failure to comply with partnership agreements.
- Removal of the agreed visibility.
- Violation of these Terms.
- Improper use of resources.
- Technical, operational, or organisational requirements.
- Economic sustainability of the Service.
- Infrastructure availability.
- Any other circumstance that makes continued participation in the Partner Program reasonably no longer appropriate.
Revocation of the Partner Program does not create any right to compensation, damages, or continued use of resources previously assigned.
28. Partner resources and infrastructure availability
Resources assigned to Partners are provided exclusively within the available capacity of the NexNode infrastructure.
Where technical, operational, maintenance, security, capacity, or sustainability requirements make it necessary to recover allocated resources, NexNode may:
- Reduce assigned resources.
- Migrate servers.
- Temporarily suspend the Service.
- Require configuration changes.
- Convert the project to the standard limits of the free plan or an available paid plan.
- Delete Partner servers where maintaining the resources is no longer reasonably sustainable.
Where reasonably possible, NexNode will provide prior notice. However, in cases of emergency, security incidents, infrastructure failures, or other urgent circumstances, action may be taken without prior notice.
29. Server & Bot paid plans
Server & Bot plans may include a total pool of RAM, CPU or vCores, storage, saved slots, and backups. The plan page and checkout state whether a limit applies per slot or to the account pool. A displayed allocation is a maximum permitted use, not ownership of hardware or a promise of dedicated capacity unless expressly sold as dedicated.
Pooled resources may be distributed among eligible servers and supported Discord bots within plan, software, node, and safety limits. NexNode may reject technically invalid combinations or require the User to reduce allocations before a downgrade takes effect.
A backup allowance means the right to create up to the displayed number of backups; it is not an archival guarantee. Users must keep independent copies of important files.
30. Web Hosting plans, domains, and hosted websites
Web Hosting plans may provide website slots, storage, traffic, databases, backups, SSL automation, File Manager, SFTP, Git deployment, WordPress, PHP, static hosting, Node.js, Docker, or other applications only where shown as available for the selected plan and node.
Registration, renewal, and ownership of custom domains and email hosting are not included unless expressly stated at checkout. A User may connect a domain they control or use an available subdomain under nexnodesite.xyz. NexNode subdomains are licensed for use with the Service, remain under NexNode's control, must be unique, and may be withdrawn for abuse, legal requirements, termination, or infrastructure changes.
The User is the publisher of their hosted website and is responsible for its content, software, licences, visitor privacy information, cookie compliance, security, and any personal data processed through it. Phishing, spam, malware, unlawful tracking, credential theft, abusive redirects, illegal content, and infringement are prohibited.
WordPress administrator and SFTP credentials must be protected and changed or reset when compromised. Initial credentials may be displayed once. SSL, DNS, databases, backups, deployments, and monitoring may depend on upstream infrastructure and third-party management systems.
31. Credits, Shop purchases, and temporary benefits
Credits are closed-loop digital units usable only for eligible NexNode Shop features. They are not money, electronic money, a deposit, an investment, or a transferable asset, and have no cash value except where mandatory law requires a remedy.
Credits may be purchased, granted as a registration or referral bonus, or awarded through promotions. The Shop shows the credit cost, target slot, quantity, duration, and resulting resource change before confirmation. Confirming a purchase deducts the displayed amount and activates or queues the selected benefit.
Temporary RAM, CPU, storage, Always On, or other benefits expire automatically and the server returns to its underlying plan limits. Rules shown before purchase govern any credit restoration when provisioning fails, a server is deleted, or a benefit is cancelled. Purchased credits expire only where an expiry was clearly disclosed when acquired and permitted by law; promotional credits may follow separately disclosed conditions.
32. Custom plans and resource pools
A Custom plan lets the User select eligible amounts of RAM, CPU, storage, server slots, and any other displayed resources. The calculator is an estimate until the final checkout states the exact quantities, billing period, taxes, minimum order, and total price.
Custom resources form an account pool and may be distributed among eligible slots subject to technical compatibility, per-server safety limits, node capacity, and supported software. A Custom plan is not a dedicated server, exclusive hardware, or a service-level agreement unless the checkout expressly says so.
Later changes to a Custom pool take effect, and are charged or credited, only according to the confirmation shown for that change. Backups or other benefits are included only in the quantity expressly displayed.
